What is changing?

The DDF® rules have been updated to permit participants to offer certain artificial intelligence, augmented reality, virtual staging and similar tools with DDF® listing content, provided the new safeguards are followed.

The new rules allow a user to choose to view an enhanced or altered version of listing content, called an “Augmentation.” The original listing content must remain unchanged and available.

REALTOR.ca DDF® does not provide this functionality. Participants that wish to offer an augmentation must develop the functionality themselves or engage a third-party technical service provider.

In simple terms:
  • the original content must be shown first and by default;
  • the user must choose to turn on the augmentation;
  • the participant must not turn on the augmentation automatically for the user;
  • the augmentation should be presented as a temporary, user-controlled overlay or alternate view that does not change the underlying content;
  • the original must remain easy to identify, find and view;
  • the augmentation must be clearly and prominently labelled while it is shown;
  • watermarks, brokerage information, attribution and required disclosures must remain visible and accurate; and
  • DDF® listing content cannot be used to train an AI system.

These changes do not give participants or service providers any new ownership, licence, sublicense or distribution rights, or general permission to edit, replace, download or republish DDF® listing content.

1. What is an “Augmentation”?

An Augmentation is a visual, informational or interactive enhancement shown using technology.

Examples may include:

  • virtual staging;
  • showing different paint colours or décor;
  • renovation visualizations; or
  • other AI or AR generated views.

In practice, an Augmentation should be presented as a temporary, user-controlled overlay or alternate view. The original listing content must remain unchanged.

2. Can participants use AI or AR with DDF® listing content?

Yes, provided the feature follows the DDF® rules.

The rules allow participants to offer a feature that a user chooses to activate. They do not allow participants to permanently change or replace the original content.

3. Does REALTOR.ca DDF® provide AI, AR, or Augmentation tools?

No. The revised rules permit participants to offer these features. A participant that chooses to do so must develop the functionality themselves or use a third-party technical service provider.

4. Can the Augmented version be shown first?

No. the original, unmodified listing content must be shown first and by default. It must remain clearly identifiable and readily available on the same website or application.

5. Can the Augmentation turn on automatically?

No. The user must take a clear action, such as selecting a button, before the Augmentation is shown. The participant must not turn it on automatically for the user.

6. Must the original content remain available?

Yes. The user must be able to easily return to and view the original content on the same website or application.

7. Must the augmentation be temporary?

The rules require the original listing content to remain unchanged and available. In practice, the Augmentation should be a temporary, user-controlled overlay or alternate view.

It should not permanently change, overwrite or replace the original listing content.

8. Must augmented content be labelled?

Yes. The Augmented content must be clearly and prominently labelled while it is being shown so that users can distinguish it from the original.

Examples include:

  • “Virtually staged”
  • “AI-generated visualization”
  • “Augmented view”

The label should appear prominently and close to the Augmented content while it is being displayed.

9. Can an Augmentation cover a watermark or brokerage information?

No. It must not hide, remove, alter, misrepresent or make less visible:

  • watermarks;
  • brokerage information;
  • attribution;
  • required disclosures; or
  • other required information.
10. Can an Augmented image replace the original listing image?

No. The Augmentation provisions require the original listing content to remain unchanged and available.

Whether an edited image may be uploaded into an MLS® system is a separate question governed by the applicable Board or Association’s MLS® system rules.

11. Is Augmentation limited to listing photographs?

No. Augmentation is not limited to listing photographs. Other listing content, such as listing descriptions, may also be presented in an augmented form, provided the original content remains unchanged and the augmentation complies with the DDF® policy and rules.

12. Can DDF® listing content be used to train AI?

No. The DDF® Rules do not provide permission to use listing content to train an AI system. An AI provider may use the content only as needed to provide the Augmentation.

13. Can a participant use a third-party AI provider?

Yes. However, the provider must act only as a technical service provider and may use the listing content only as needed to provide the Augmentation.

The provider must not:

  • train AI using the content;
  • reuse it for another purpose;
  • sell or distribute it;
  • use it to improve another product; or
  • be granted a separate licence or other right to the content.
14. Can users download or share an Augmented image?

The revised rules do not create a new right to download, republish or distribute DDF® listing content or an Augmented version. A participant must not allow those uses.

15. Can an Augmentation include advertising or branding?

Not automatically. An AI or AR feature must also comply with the existing advertising and co-branding rules.

For example, advertising or co-branding cannot appear with listing content on a National pool website, including within an Augmentation.

16. Do local Board or Association rules still apply?

Yes. Participants must also comply with applicable:

  • Board or Association rules;
  • MLS® System requirements;
  • CREA and REALTOR.ca Canada Inc. policies; and
  • laws and regulations.
17. What happens if an Augmentation feature does not comply with the DDF® policy and rules?

The applicable Board/Association or REALTOR.ca Canada Inc. may require the participant to change or remove the feature. DDF® access or specific functions may also be suspended or terminated.

18. Do the new Rules give participants or service providers new rights in listing content?

No. Augmentation does not create any ownership, licence, sublicense, distribution or other right in the underlying listing content. It may be used only as permitted by the DDF® Rules.

19. Can a participant send a user and the listing content to a separate public AI website or app?

No. The Augmentation must remain part of the participant’s website or application. A third-party provider may support the feature only as a technical service provider and cannot use the content for its own purposes.

20. Who is responsible for a third-party provider?

The participant is responsible for ensuring that the feature and provider comply with the DDF® rules. The agreement with the provider should limit its use of listing content to providing the Augmentation.
